The buyer is aware that the system is used. §2 Purchase Price The purchase price is negotiable. VAT can be itemized separately. §3 Collection The buyer is obliged to dismantle the system at their own cost and responsibility at the seller’s location. Dismantling must take place at a date agreed at least in text form between the parties. The agreed date must be selected so that the general business operations of the seller are not disrupted. The seller will grant the buyer access to the premises for dismantling the system, provided all safety and access regulations of the seller are observed by the buyer. Risk of accidental loss passes to the buyer upon handover at the location. Handover occurs, at the latest, when the buyer begins dismantling the system independently. §4 Warranty and Liability The buyer purchases the system as seen. The seller excludes any warranty or liability regardless of the nature of the asserted claim, unless a guarantee regarding the condition of the goods was expressly provided or a defect was maliciously concealed. This exclusion does not apply to claims for damages—regardless of the legal grounds—if the seller, its legal representatives or agents have acted with gross negligence or intent, or with respect to liability prescribed by law, such as product liability. §5 Retention of Title Ownership of the items remains with the seller until full payment of the purchase price has been received.
